GENERAL TERMS AND CONDITIONS

1. SCOPE

These General Terms and Conditions (hereinafter referred to as GTC) apply to the provision of rooms and/or conference and banquet facilities as well as all related additional services and deliveries by Hotel Jägerhof Zermatt AG (hereinafter referred to as Hotel Jägerhof) to customers. All offers from Hotel Jägerhof are based on these GTC. They form an integral part of every contract. Changes to these GTC require an explicit written agreement between the parties. This also applies to the cancellation of the written form requirement. Should these GTC contradict any contractual conditions of the customer, the present GTC shall prevail.

2. CONCLUSION OF CONTRACT

Following the reservation by the customer, the customer will receive a written reservation confirmation from Hotel Jägerhof (via email, fax, or letter). The contract between the parties is only concluded with this written reservation confirmation from Hotel Jägerhof to the customer.

3. SERVICES, PAYMENTS, AND PRICES

3.1

Hotel Jägerhof is obliged to provide the services ordered by the customer and confirmed in writing by Hotel Jägerhof.

3.2

All prices are in Swiss Francs (CHF) and include the statutory value-added tax (VAT).

3.3

Hotel Jägerhof is entitled to demand a reasonable deposit at any time. The amount of the deposit and the payment dates will be agreed upon in writing in the contract. If the customer fails to make the deposit in a timely manner, Hotel Jägerhof is entitled to withdraw from the contract after setting a reasonable grace period. The customer is liable to Hotel Jägerhof for any resulting damages.

3.4

Unless a deposit is required by Hotel Jägerhof, the total invoice amount must be paid by the customer at the latest by the time of departure, either by credit card or in cash. If payment by invoice is agreed upon, the total invoice amount is due 30 days after the invoice date. In case of late payment, Hotel Jägerhof is entitled to charge default interest of 5%.

3.5

Price changes by Hotel Jägerhof are expressly reserved.

4. LIABILITY

4.1

The customer is liable to Hotel Jägerhof for all damages and losses or other damages caused by themselves, their employees, their agents, their event participants, or other third parties. Hotel Jägerhof disclaims any liability for theft and damage to items brought in by the customer, event participants, or third parties. Insurance for exhibition objects and other items brought in by the customer, event participants, or third parties is the responsibility of the customer. Hotel Jägerhof may at any time require proof of adequate insurance from the customer.

4.2

The customer is obliged to maintain peace and order. They agree to fully indemnify Hotel Jägerhof against all civil and public law claims made against Hotel Jägerhof by authorities or third parties (including event participants, guests, or employees and contractual partners of the customer) due to their event.

4.3

Hotel Jägerhof is only liable for intentional or grossly negligent contractual or non-contractual damage and only for direct damages. Any further liability, especially in cases of slight or moderate negligence or for indirect damages, such as lost profits, is excluded. In the case of mediation of external services, Hotel Jägerhof assumes no liability for the services ordered by the customer.

5. WITHDRAWAL BY HOTEL JÄGERHOF

5.1

If the service to be provided by Hotel Jägerhof is made impossible or significantly more difficult in whole or in part due to force majeure (according to Swiss understanding, in particular natural disasters such as storms, floods, or earthquakes, as well as fire, hostage-taking, war, riots, nuclear & reactor accidents, strikes, unforeseeable official restrictions, etc.) or other circumstances for which Hotel Jägerhof is not responsible, Hotel Jägerhof may withdraw from the contract in the scope of the part of the contract that has not yet been fulfilled without compensation.

5.2

Hotel Jägerhof is also entitled to withdraw without compensation if there is reasonable cause to believe that the event may jeopardise the smooth operation of the business, the safety, or the reputation of Hotel Jägerhof in public, or if the customer violates clause 12 of these GTC. Any claims for damages from Hotel Jägerhof against the customer are expressly reserved.

6. "NEWSLETTER", "PRE-STAY" AND "POST-STAY" EMAILS

6.1

Hotel Jägerhof Zermatt AG is entitled to forward personal data of the guest, in particular the booking data (e.g. salutation, first name, last name, date of birth, nationality, language, email address, mobile phone number, postal address, number of persons, arrival date, departure date, overnight stays, and any exemption from tourist tax) to Zermatt Tourism. This personal data will be stored centrally by Zermatt Tourism (and/or by data processors on behalf of Zermatt Tourism). In this context, it is possible that information and/or newsletters are sent directly to the guest by Zermatt Tourism and/or Hotel Jägerhof Zermatt AG. It is also possible that such information is sent on behalf of Hotel Jägerhof Zermatt AG but technically generated by Zermatt Tourism (and/or a data processor on behalf of Zermatt Tourism). This information particularly includes so-called "Pre-Stay" and "Post-Stay" emails.
