GENERAL TERMS AND CONDITIONS

1. SCOPE OF VALIDITY

These General Terms and Conditions (hereinafter referred to as GTC) apply to the provision of rooms and/or conference and banqueting facilities as well as to all related services and deliveries of Hotel Jägerhof Zermatt AG (hereinafter referred to as Hotel Jägerhof) for customers. All offers from Hotel Jägerhof are based on these terms and conditions. They form an integral part of every contract. Changes to these GTC require express written agreement between the parties. This also applies to any dispensation with this requirement for the written form. If these GTC conflict with any contractual terms of the customer, these GTC shall take precedence.

2. CONCLUSION OF CONTRACT

After the customer makes a reservation, he or she shall receive a written confirmation from Hotel Jägerhof (by email, fax or letter). The contract between the parties is only realised upon this written reservation confirmation being sent from Hotel Jägerhof to the customer.

3. SERVICES, PAYMENTS AND PRICES

3.1 Hotel Jägerhof undertakes to provide the services ordered by the customer and promised in writing by Hotel Jägerhof.

3.2 All prices are in Swiss Francs (CHF) and include statutory value-added tax (VAT).

3.3 Hotel Jägerhof is entitled to demand a reasonable advance payment at any time. The amount of the advance payment and the payment dates are agreed in writing in the contract. If the customer does not fulfil his or her obligation to provide this advance payment on time, Hotel Jägerhof is entitled to withdraw from the contract after providing the customer with a reasonable grace period. The customer is liable to Hotel Jägerhof for the resulting damage. 3.4 If no advance payment is required by Hotel Jägerhof, the total amount of the invoice must be paid by the customer, by credit card or in cash, at the latest by the time of departure. If payment by invoice is agreed, the total invoice amount is due 30 days after the invoice date. In the event of late payment, Hotel Jägerhof is entitled to charge default interest of 5%. 3.5 Hotel Jägerhof expressly reserves the right to changes prices without notice.

4. LIABILITY

4.1 The customer is liable to Hotel Jägerhof for all damages and losses or other damages caused by the customer himself, his employees, his agents, his event participants or other third parties. Hotel Jägerhof disclaims all liability for theft and damage of items brought onto its premises by the customer, event participants or third parties. It is the customer's responsibility to insure exhibited objects and other items brought onto the premises by the customer, event participants or third parties. Hotel Jägerhof can demand proof of adequate insurance from the customer at any time.

4.2 The customer is obliged to maintain peace and order. He undertakes to fully indemnify Hotel Jägerhof against all claims under civil and public law raised by authorities or third parties (including event participants, guests or employees and contractual partners of the customer) against Hotel Jägerhof due to its event.

4.3 Hotel Jägerhof is only liable for contractual or non-contractual damages caused by intent or gross negligence, and only for direct damages. Any further liability, in particular in the case of slight or moderate negligence or for indirect damages, such as, in particular, loss of profit, is excluded. When arranging external services, Hotel Jägerhof assumes no liability whatsoever for the services ordered by the customer.

5. RESCISSION BY HOTEL Jägerhof

5.1 If services that are contractually to be provided by the Hotel Jägerhof are impeded or made impossible, in whole or in part, due to force majeure (according to the Swiss understanding, in particular natural catastrophes such as heavy gales, floods or earthquakes as well as fire, hostage-taking, war, riots, nuclear & reactor accidents, strikes, unforseeable regulatory restrictions, etc.) or other circumstances for which Hotel Jägerhof is not responsible, Hotel Jägerhof may withdraw from the contract, in whole or in part, without providing compensation, to the extent of the part of the contract not yet fulfilled.

5.2 In addition, Hotel Jägerhof is entitled to rescind the contract without providing compensation if there are reasonable grounds to believe that the event may jeopardise the smooth running of the business, safety, or the public reputation of Hotel Jägerhof, or if the customer breaches Section 12 of these GTC. Any claims for damages from Hotel Jägerhof towards the customer are expressly reserved.

6. NEWS LETTER, PRE-STAY AND POST-STAY E-MAILS

The Hotel Jägerhof Zermatt AG is authorized to transfer the guest’s personal data in particular the booking details (e.g., salutation, first name, last name, date of birth, nationality, language, email, mobile phone number, address, arrival and departure date, number of persons, overnight stays and potential exemption from the visitor's tax) to Zermatt Tourismus. This personal data is stored centrally by Zermatt Tourismus (and/or by data processors commissioned by Zermatt Tourismus). It is therefore possible that information and/or newsletters may be sent to the guest directly by Zermatt Tourismus and/or by the Hotel Jägerhof Zermatt AG. It is also possible that this information may be sent in the name of the Hotel Jägerhof Zermatt AG but it has actually been generated by Zermatt Tourismus (and/or data processors commissioned by Zermatt Tourismus). This information relates especially to «pre-stay» and «post-stay» emails.
